WORLD SKATE PRIVACY POLICY

Introduction

With this Privacy Policy, provided in compliance with article 13 and 14 of the European Regulation No. 679/2016 GDPR (hereinafter, “GDPR”) and articles 19 and 20 of the New Federal Act on Data Protection (hereinafter “nFADP”) and article 13 of the Data Protection Ordinance, World Skate provides you with detailed information regarding the processing of your personal data, so that you know what data we collect about you, the reasons why we use and share such data, how long we keep it, what your rights are and how you can exercise them.

We also inform you that you may be provided with dedicated disclosures for particular initiatives and/or certain services (e.g., to register in Infinity platform), to illustrate the characteristics of the specific processing put in place in such cases. The dedicated disclosures are supplemented by this policy regarding the processing of personal data of users of World Skate. Unless otherwise indicated, in case of conflict, the information rendered within the dedicated disclosures prevails over the following.

This Policy does not apply to the processing of data for anti-doping activity and purposes. The latter matters shall be conducted in accordance with the terms and conditions set out in World Skate Anti-Doping Policy on Collection, Processing and Protection of Personal Data and Personal Information.

Lastly, we remind you that any processing of personal data put in place by third party owners of other websites, even if they can be reached through links / plug-ins, will be subject to the processing disclosures proposed by such third parties.

Data Controller and Data Protection Officer (DPO)

Types of Data 

For its Processing Purposes described in the following paragraph, World Skate may collect the following types of personal data: 

       A. Common Data, i.e. as:

  • Data subject’s Identity (ex. Full name, Date of Birth, Place of Birth; ID number and expiry date, Social Security number);
  • Contact Details (ex. Phone number(s), E-mail Address(es), Home Address(es) Social media contacts, Names and details of contact people);
  • Expertise (ex. Sports Discipline/s and any other relevant sports information, Curriculum Vitae, Resume, Qualification, Occupation, Organizations to which he/she belongs);
  • Marital status;
  • Travel Schedule;
  • Insurance policy number;
  • Personal Pictures (ex. Photografhs and/or videos);
  • Fiscal Data (ex. Tax ID, Bank details).

       B. Special categories of personal data, i.e. as: 

  • Dietary preferences;
  • Pictures for identification and accreditation cards;
  • Data concerning health (ex. Medical and pharmaceutical needs; Food intolerances).

       C. Data relating to criminal convictions and offences.

Processing Purposes and Lawfulness of processing 

World Skate may collect your personal data for the following Processing Purposes:

  1. To achieve institutional goals, as indicated in World Skate Statutes and for the performance of the statutory duties. The Processing Purpose, for example, shall include every activity necessary to stage, organize, implement, recognize or take part in competitions and events directly organized by World Skate, as well as for those events entrusted and/or subcontracted to third parties by World Skate. 

For this purpose, common data will be processed as described in section A [Art. 6, par. 1, lett. b) GDPR, Art. 10 GDPR, Art. 31, par. 1 and par. 2, lett. a) nFADP].

When and if necessary, subject to your consent, special categories of personal data will be processed, as described in section B and C [Art. 9, par. 2, lett. a) GDPR, Art. 6, par. 7, lett. a) nFADP].

  2. To document, communicate and promote the development of all Sports governed by World Skate. The Processing Purpose, for example, shall include the taking video footages and/or pictures during public events (such as competitions, ceremonies, side events, etc.) of World Skate and their publication on WS channels. If necessary, World Skate will provide in advance notice to the public, the participants and any other person taking part in and/or attending the event through general notices to be displayed and/or posted at key points inside and outside the venue(s). The filming of the individual will always be preceded by specific information in order to collect your consent. 

For this purpose, common data, as your personal pictures, will be processed [Art. 6, par. 1, lett. f) GDPR, Art. 31, par. 2, nFADP].

  3. To send news and information to athletes, officials and National Federations.

Your personal data is processed for the purpose of sending communications about events and/or competitions of WS. These activities may be carried out through, for example, through automated means of contact (ex. e-mail) . The provision of personal data for the purpose set out in this point is optional and refusal will not affect the performance of the contractual relationship.

For this purpose, common data, as your e-mail, will be processed [Art. 6, par. 1, lett. f) GDPR, Art. 31, par. 2, nFADP].

  4. To prevent and protect from fraudulent activities.

Finally, your Personal Data may be processed in order to perform security audits with the purpose of prevention and protection from fraudulent activities, counterfeiting and abusive behavior, including by third parties) conflicting with applicable regulations, contractual provisions applicable to World Skate and related Services, rules of fairness and good faith and for the protection of the rights of the Owner in court for the management of any litigation.

For this purpose, common data will be processed as described in section A  [Art. 6, par. 1, lett. f) GDPR, Art. 31, par. 2, nFADP].

  5. To complain about legal and admimìnistrative obligations.

Furthermore, we may use your Personal Data for the administrative and accounting management of the obligations provided by laws, regulations or Community legislation or imposed by the Authorities as, i.e., IOC. 

For this purpose, common data will be processed as described in section A and, when and if necessary, special categories of personal data as described in section B [Art. 6, par. 1, lett. c) and art. 9 par. 2 lett. b) GDPR, Art. 31, par. 1, nFADP].

Processing methods

The personal data collected will be processed using electronic and/or paper-based tools. In order to comply with the provisions of the relevant legislation, the Data Controller has adopted and implemented all appropriate technical and organisational measures to ensure a level of security appropriate to the risk, in accordance with article 32 of the GDPR and article 8 of the nFADP.

Communication and diffusion of personal data 

Your personal data, for the pursuit of the above-mentioned Processing Purposes and/or to comply with legal obligations, may be disclosed to third parties who operate independently as separate Data Controllers, i.e. as:

  • Public and private entities;
  • Operators, professionals and specialists who carry out activities closely related to the exercise of health professions or to the provision of goods, benefits or services to the data subject during events and/or competitions;
  • Anyone who is a legitimate recipient of communications required by law or regulations.

 

Furthermore, your Personal Data, as indicated below,  may be published for institutional communication activities, including the diffusion of results and images relating to competitions and/or sporting events, publications of an informative and popular nature aimed at the promotion of roller sports.

 

Your data may be transmitted to third parties specifically appointed as Data Processors pursuant to Art. 28 GDPR and Art. 9 nFADP (for example,  IT service providers, event/competition hosts, legal advisors event/competition hosts, legal advisors),  whose work the Federation avails itself of in the context of service provision relationships, as well as to any person acting under the authority of the controller or of the processor pursuant to Art. 29 GDPR, for the purposes set out in this policy and limited to their respective competences.

Your personal data will not be disclosed, unless required by a law or regulation or by EU legislation.

Data retention

Personal data shall be retained for the purpose described above and, after its termination, for the ordinary limitation period of ten years for the fulfilment of legal obligations to which the Data Controller is subject and, where necessary, for the ascertainment, exercise and defence of the Federation’s rights in any forum. Beyond this period, the data will be kept anonymously or will be deleted.

In some cases (e.g. data and information relating to the results of sporting events played; recordings, films and and images taken during public events for dissemination and promotional purposes, etc.), the data will be retained unlimited for historical-statistical purposes as well as documentation of World Skate’s activities and the history of all Sports governed by World Skate. 

Transfer of data to third countries (Article 44-49 GDPR; Articles 16-17 nFADP)

Any transfer of personal data which are undergoing processing or are intended for processing after transfer to a third country or to an international organisation shall take place only if the conditions laid down in Chapter n. 5 GDPR e articles 16-17 nFADP are complied with by the Controller and Processor, including for onward transfers of personal data from the third country or an international organisation to another third country or to another international organisation. 

Data subject right (Articles 15-22 GDPR; Articles 25-29 nFADP)

We inform you that, in relation to the purposes of the processing, you are granted the following rights:

  • access to the data concerning you and acquisition of a copy thereof (art. 15 GDPR); 
  • rectification and integration of personal data if inaccurate or incomplete (art. 16 GDPR); 
  • deletion of personal data, where applicable (art. 17 GDPR); 
  • limitation of data processing, if the conditions are met (Art. 18 GDPR);
  • portability, understood as the right to obtain the data in a structured, machine-readable format for transmission to another data controller without hindrance (Art. 20 GDPR);
  • objection to the processing of data on grounds relating to your particular situation (Art. 21 GDPR);
  • revocation of consent to the processing, without prejudice to the lawfulness of the processing based on the consent obtained before revocation (Art. 7(3) GDPR);
  • lodging a complaint with the Data Protection Authority for the protection of your personal data and your rights (Art. 51 GDPR).

In any case, the interested party always has the right to lodge a complaint with the Personal Data Protection Authority (Art. 77 GDPR) and to bring proceedings before the competent judicial authorities (Art. 79 GDPR; Art. 32 nFADP) based on the country of residence of the person concerned.
